1 Acceptance of These Terms
By accessing or using Prompt Gen, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
If you are using Prompt Gen on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes the organization.
2 What Prompt Gen Does
Prompt Gen helps users convert human ideas into structured prompts optimized for AI assistants. Prompt Gen provides category-based guidance and may store prompt history for signed-in users.
3 Eligibility
You must be legally able to form a binding contract in your jurisdiction to use the Service. If you are under the age of majority, you may use the Service only with permission of a parent/guardian.
4 Accounts, Security, and Verification
- You may need to create an account to access certain features (e.g., history, regeneration).
- You agree to provide accurate account information and keep it updated.
- You are responsible for safeguarding your credentials and any activity under your account.
- Email verification and OTP checks may be used to protect account integrity.
5 User Content and Inputs
"User Content" includes text you submit (inputs) and prompts generated and saved to your account (history).
6 Prohibited Use
You agree not to:
- Use the Service for unlawful, harmful, or fraudulent activities.
- Attempt to bypass security, authentication, rate limits, or access controls.
- Interfere with the Service's operation (e.g., scraping, denial-of-service, automated abuse).
- Upload or submit content that infringes intellectual property rights or violates privacy laws.
- Use Prompt Gen to generate or facilitate content that is illegal or otherwise prohibited by applicable law.
We may suspend or terminate access if we reasonably believe you violated these Terms or used the Service in a way that creates risk or legal exposure.
7 AI Outputs Are Not Guaranteed; You Must Review
Prompt Gen outputs are generated using AI and may be inaccurate, incomplete, biased, or unsuitable for your use case.
You are responsible for reviewing and validating outputs before using them for:
- Legal, medical, financial, compliance, safety-critical, or other high-stakes purposes.
- Nosant does not provide professional advice.
8 Third-Party Services and AI Providers
Prompt Gen may rely on third-party services, including AI model providers and infrastructure vendors. Your input may be transmitted to these providers to generate outputs. Third-party terms may apply.
Nosant is not responsible for outages, changes, or policies of third-party services.
9 Intellectual Property
Prompt Gen, including branding, UI, code, and all associated materials, is owned by Nosant or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer the Service except as permitted by law.
10 Availability, Changes, and Updates
- We may change, suspend, or discontinue all or part of the Service at any time, including features and pricing.
- We may update these Terms periodically. If changes are material, we will provide notice by posting updated Terms with a new effective date.
- Continued use after changes become effective means you accept the updated Terms.
11 Termination
You may stop using Prompt Gen at any time. We may suspend or terminate your account if:
- You violate these Terms,
- Your use creates risk to the Service or others, or
- Required by law.
Upon termination, your access ends. Where applicable, you may request deletion of account data as described in the Privacy Policy.
12 Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOSANT DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Nosant does not warrant that the Service will be uninterrupted, error-free, or that outputs will meet your requirements.
13 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- NOSANT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.
- NOSANT'S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO NOSANT FOR THE SERVICE IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR USD $50 IF YOU PAID NOTHING), WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations; in that case, the limitation applies to the maximum extent permitted.
14 Indemnity
You agree to indemnify and hold harmless Nosant from claims, damages, liabilities, and expenses arising from:
- Your use of the Service,
- Your User Content,
- Your violation of these Terms, or
- Your violation of any applicable law or third-party rights.
15 Governing Law and Disputes
These Terms are governed by the laws of Zimbabwe, without regard to conflict of law rules. Disputes will be resolved in the courts of Harare, Zimbabwe, unless applicable law requires otherwise.
